Gurugram: Residents' body urges officials to take action against illegal encroachments in Sector-42

Gurugram, Jul 5 (PTI) A residents' body in Gurugram has urged Haryana government authorities to launch immediate enforcement action against what it alleges is a large-scale illegal commercial cluster operating on government land in Sector 42, claiming that official surveys and restoration orders have remained unimplemented for over a year. The Global Foyer Condominium Association has alleged that unauthorised shops, eateries, meat outlets, courier centres, building material depots, pharmacies and other commercial establishments continue to function on government land near Golf Course Road despite official findings identifying the encroachments. The association made its representation to multiple state agencies, including the Gurugram Metropolitan Development Authority (GMDA), HSVP, Municipal Corporation of Gurugram (MCG), Haryana State Pollution Control Board (HSPCB) and the district administration. The association has referred to a GMDA survey conducted on June 9, 2025, which allegedly identified unauthorised commercial establishments spread across Khasra numbers 535, 536, 537, 538 and 540 near Krishna Hotel, opposite Global Foyer Mall. It further pointed to a GMDA restoration order dated January 13, 2026, directing owners or occupiers to remove the unauthorised structures within 15 days, alleging that the order has not yet been enforced. According to the representation, the continued commercial activity has resulted in traffic congestion, pollution, safety concerns and encroachment on public land along one of the city's premium corridors. The association has sought coordinated action by civic, planning, revenue and utility departments to remove the alleged encroachments and prevent restoration of electricity and other services to unauthorised structures. The complaint also relies heavily on the Supreme Court's December 2024 judgment in Rajendra Kumar Barjatya & Another vs U.P. Avas Evam Vikas Parishad & Others, arguing that authorities have a statutory obligation to remove illegal constructions and that administrative delay cannot be cited as a defence against enforcement. The representation notes that the apex court also warned of departmental action against officials who fail to discharge their statutory responsibilities in dealing with unauthorised constructions. Supporting documents attached with the representation include copies of GMDA correspondence seeking demarcation of the land, revenue records, DGPS-based demarcation reports and a list of commercial establishments allegedly operating from the site. The enclosure also contains maps identifying the concerned khasra numbers and survey reports prepared during the demarcation exercise. The association has requested the authorities to initiate demolition of unauthorised structures, remove encroachments from government land and take action against officials if any dereliction of duty is established.
